• Impersonates any person, business or entity from 2012online.org or falsely states or otherwise misrepresent your affiliation with any person, business or entity, 2012online.org;
• Contains an advertisement or solicitation or encourages others to make a donation;
• Contains viruses or any other computer code, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment, or otherwise permit the unauthorized use of a computer or computer network;
• Encourages conduct that would constitute a criminal offense or that gives rise to civil liability or that otherwise encourages others to commit illegal activities or cause injury or property damage to any other person;
• Results in the posting or transmission of any message anonymously or under a false name;
• Permits any person to access, using your account, any features of 2012online.org that may require registration;
• Results in a single message being posted to more than five areas of 2012online.org, results in any message being posted to any area of 2012online.org if that message is, in our view, off-topic or in violation of this Visitor Agreement; or
• Violates these Terms of Use, guidelines or any policy posted on 2012online.org, or interferes with the use of 2012online.org by others.

Although 2012online.org cannot monitor all content on 2012online.org community and social media sites, or postings in the chat rooms, forums, blogs and other public posting areas, you understand that 2012online.org shall have the right, but not the obligation, to monitor the content of the 2012online.org to determine compliance with this Visitor Agreement and any other operating rules that may be established by 2012online.org from time to time. 2012online.org shall have the right, in its sole discretion, to edit, move, delete, or refuse to post any material, including violation of these Terms of Use, whether for legal or other reasons, or because the material is objectionable or stale. Notwithstanding this right of ours, users shall remain solely responsible for the content of their messages. You acknowledge and agree that 2012online.org shall assume or have any liability for any action or inaction by 2012online.org with respect to any conduct within 2012online.org or any communication or posting on 2012online.org. 2012online.org also reserves the right to disclose any information that 2012online.org believes necessary to satisfy any law, regulation or governmental request, or to refuse to post or to remove any information or materials, in whole or in part.

USE OF MATERIALS

Any material you submit to any of our chat rooms, forums, blogs and other public posting areas, whether text or images, becomes the property of 2012online.org and may be reproduced, modified and distributed as we see fit, in any medium, for any purpose and in perpetuity. Further, you understand that by posting material on 2012online.org’s community and social media sites, you are granting to 2012online.org, and to anyone authorized by 2012online.org, a royalty-free, perpetual, irrevocable, non-exclusive, unrestricted, worldwide license to display, use, copy, modify, transmit, sell, exploit, create derivative works from, distribute, and/or publicly perform such materials posted on 2012online.org’s community and social media sites, in whole or in part, in any manner or medium, now known or hereafter developed, for any purpose. The foregoing grant shall include the right to exploit any proprietary rights in such posting or submission, including, but not limited to, rights under copyright, trademark, service mark or patent laws under any relevant jurisdiction. Also, in connection with the exercise of such rights, you grant 2012online.org, and anyone authorized by 2012online.org, the right to identify you as the author of any of your postings or submissions by name, email address or screen name, as 2012online.org deems appropriate. The materials available through 2012online.org are the property of 2012online.org, and are free to display and print for your personal, non-commercial use information you receive through 2012online.org. You may not distribute copies of materials found on 2012online.org in any form (including by e-mail or other electronic means), without prior written permission from the owner. Of course, you're free to encourage others to access the information themselves on 2012online.org, and to tell them how to find it.

NO FRAMING

Without the prior written permission of 2012online.org, you may not frame, or make it appear that a third-party site is presenting or endorsing, any of the content of 2012online.org, or incorporate any intellectual property of 2012online.org into another website or other service.
TRADEMARKS

We don't want anyone to be confused as to which materials and services are provided by 2012online.org and which are not. You may not use any trademark or service mark appearing on 2012online.org without the prior written consent of the owner of the mark.

MISCELLANEOUS

DONATION SERVICE

This Service -- the 2012online.org Donation button -- may be used by a 2012online.org user ("Donor") to make a donation via electronic funds transfer to a designated receiver ("Donee").

2012online.org will also offer you the ability to use PayPal, Inc., a Delaware corporation having its principal offices at 1840 Embarcadero Road, Palo Alto, California 94303 ("PayPal"). 2012online.org relies upon PayPal to maintain all necessary licenses and permits required by the laws and regulations of the countries from which the payments are sent and as may otherwise be applicable. Hence it will be necessary for the Donor to open a PayPal account, and be subject to the applicable PayPal Terms of Use. See http://www.paypal.com/cgi-bin/webscr?cmd=p/gen/terms-outside. 2012online.org is not affiliated with PayPal, as each is an independent contractor, and neither is the agent or employee of the other, and neither is responsible in any way for the actions or performance (or lack thereof) of the other.

FURTHER DONATION SERVICE UNDERSTANDINGS

Donor may utilize any medium of donation acceptable to Credit Card Processor or PayPal, as applicable, such as Visa and MasterCard debit cards, American Express or other credit cards, or electronic checks (together, "Donation Medium"). 2012online.org, the Credit Card Processor and/or PayPal, in such entity's sole discretion, may refuse or limit the amount to be transferred, either on a per transaction basis or on the basis of the aggregate transferred by any single Donor during a particular period selected. 2012online.org reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the services (or any part thereof) with or without notice.

DONATION INFORMATION

2012online.org will require Donor to provide certain information to allow it and/or Credit Card Processor or PayPal, as applicable, to, among other things, verify the Donor's identity, ascertain accurately the identity and location of the Donee, obtain the appropriate Donation Medium authorization, and to comply with all applicable laws and regulations ("Government Regulations").

Under no circumstances will 2012online.org permit the transfer of funds for illegal purposes or in violation of Government Regulations, including without limitation, transfer of funds to organizations and persons prohibited from receiving such funds by the U.S. Treasury Department or another country's government.

2012online.org does not disclose nonpublic personal information about 2012online.org users to anyone for the purpose of marketing or soliciting third party products or services. 2012online.org may disclose some or all of the nonpublic personal information described above to independent contractors and service providers for the purposes of processing requested transactions. Its agreements with these service providers contain confidentiality provisions and restrictions on using this information for any other purposes.

Access to non-public personal information about Donors and Donees, including transaction history, is restricted to 2012online.org, independent contractors, or service providers who need to have access to that information to process the funds transfer transactions. 2012online.org may also disclose certain information as required or permitted under applicable law, for example, to government agencies. It maintains physical, electronic and procedural safeguards that comply with United States government and other country's standards to guard its users' nonpublic personal information.

DONATION FEES

In consideration for the use of the service, you, the Donor, agree to pay to 2012online.org fees for each donation initiated by you at the applicable rate then in effect as indicated on accompanying parts of our web site. These fees are shown to you prior to your acceptance of the authorization and charge to be made to your Donation Medium. The fees charged by 2012online.org may include amounts payable to Credit Card Processor or PayPal, as applicable, and handling and service charges and fees for using the 2012online.org Donation Button. These fees are not surcharges for the use of Donation Mediums, and may be charged to the Donor regardless of the form of donation. The fees and the principal amount must be paid before the transaction is processed.

TRANSFER OF FUNDS

All Donations are final after processing. The Donor may request a cancellation of the transaction only if the request is received by the Credit Card Processor or PayPal, as applicable, or the 2012online.org prior to delivery of the funds to the Donee, so that 2012online.org may make reasonable effort to effect such requested cancellation.

You agree to indemnify, defend and hold harmless 2012online.org from and against any and all losses, expenses, damages and costs (including reasonable attorneys' fees) resulting from any violation of this Visitor Agreement or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing 2012online.org using your account.

In the event that any portion of this Visitor Agreement is found to be invalid or unenforceable for any reason, such invalidity or unenforceability shall not affect the enforceability or validity of any other portion of this Visitor Agreement, which shall remain in full force and effect and be construed as if the invalid or unenforceable portion were not part of the Visitor Agreement.
